    1. We, Clydesdale Bank Plc, operate our website which is accessible at developer.cybonline.co.uk (the “Website”), and which is made available to you in accordance with these Terms of Use.

These Terms of Use do not govern, or in any other way affect your access and/or use of our Open Banking APIs and development testing areas (together the “API”) which is made available to you by registering with Open Banking. Our API has been developed to comply with the Payment Services Directive 2015/2366 and the associated Regulatory Technical Standards, as implemented by the Payment Services Regulations 2017 (“Open Banking Requirements”).
    3. Clydesdale Bank PLC (which is registered in Scotland at registered office 30 St Vincent Place, Glasgow G1 2HL with Company No SC001111), each subsidiary or holding company of Clydesdale Bank PLC from time to time, and each subsidiary from time to time of any such holding company. For the avoidance of doubt the CB Group includes, among others, Yorkshire Bank Home Loans Limited (Company No 01855020) which is registered in England and Wales at registered office 20 Merrion Way, Leeds LS2 8NZ. Clydesdale Bank PLC, which also trades as Yorkshire Bank, is authorised by the Prudential Regulation Authority and regulated by the Financial Conduct Authority and the Prudential Regulation Authority.     1. This Website provides you with information about our API, and includes details of the technical specifications of our API. Please note that data provided through our API relates to the UK only, and is prepared to the Open API, data format and security standards as maintained by the Open Banking Implementation Entity (“OBIE”). The API technical documentation available on this Website will identify where deviations from the OBIE have been made (as applicable).
    2. We regularly review the content on our Website. However, we cannot guarantee that all content on our Website is accurate, complete or up to date.  We therefore make no warranties, representations, undertakings or guarantees that the content on our Website is accurate, complete or up to date, or that it will be free from errors or omissions.
    3. Our Website is made available to you free of charge. We do not guarantee that access to our Website, or the content on it, will be available or uninterrupted at all times.
    4. Our Website will, from time to time, provide you with information about availability issues affecting our API, and this information will be provided via a notification banner within each endpoint site page of this Website.
    5. Service level information and related performance statistics about the API will be made available on this Website in due course. In the meantime, please contact Support for more information.
    6. We make no warranties, representations, undertakings or guarantees that our Website is secure or free from bugs or viruses. You are responsible for ensuring that the device from which you access our Website has suitable anti-virus software in place.
  4. Restrictions on your use of our Website
    1. You may only use our Website for lawful purposes, and in compliance with all applicable laws, data protection and privacy laws, laws relating to copyright of content and laws relating to unsolicited commercial electronic messages.

Without prejudice to our obligations set out in the Open Banking Requirements in connection with your use and/or access to our API, we will not be liable to you for any loss or damage arising out of or in connection with your use of (or inability to use) our Website or your use of or reliance upon any content on our website, whether in contract, tort (including without limitation negligence), misrepresentation, restitution, under statute or otherwise.
    3. Our Website may contain links to other Websites from time to time. These links are provided for your convenience.  We have no control over, and no responsibility or liability to you for, those other Websites or their content.

    1. We make changes to the Website and/or these Terms of Use from time to time. You should therefore check these Terms of Use whenever you return to our Website to see whether any changes have been made. We also make changes to our privacy policy and cookies policy from time to time, so you should also check these regularly to see whether any changes have been made.
  8. Applicable law
    1. These Terms of Use (and any non-contractual obligations arising out of or in connection with them) are governed by the law of England and Wales and the courts of England and Wales have exclusive jurisdiction to determine any dispute arising out of or in connection with them (including without limitation in relation to any non-contractual obligations).
